General Terms and Conditions (GTC)
1. General Provisions, Scope of Application
1.1 All deliveries and services provided by TOURING Modelcars, represented by Thomas Langejürgen, Bunsenstr. 1, D-32052 Herford, Germany (hereinafter "TOURING Modelcars"), are exclusively based on the following General Terms and Conditions in their version valid at the time of the order. Deviating business conditions shall only apply if they have been expressly agreed upon in writing.
1.2 Customers within the meaning of these terms and conditions are both consumers and businesses. Consumers are natural persons who enter into a legal transaction for purposes that are predominantly outside their trade, business, or profession. Businesses are natural or legal persons or partnerships with legal capacity who, when entering into a legal transaction with TOURING Modelcars, act in the exercise of their trade, business, or profession.
2. Conclusion of the Contract
2.1 Orders can be placed by telephone, email, fax, or through our online shop. By placing an order, you make a binding offer to conclude a contract. We accept this offer by sending you a confirmation via email, fax, or post within 72 hours of receiving the order. The contract is concluded with the dispatch of this order confirmation.
2.2 You can view the contents of the shopping cart at any time by clicking the [Cart] button. Products can be removed by clicking the [Remove item] graphic or adjusted by changing the quantity [Change quantity]. To complete the purchase, click on "Proceed to the next step." In the following steps, you can optionally create a customer account, enter your order details, and choose the shipping and payment method. In the final step, under "Please review your order," you will receive an overview and can make changes if necessary. To confirm the order, you must accept our General Terms and Conditions and click the [Buy] button.

3. Storage of the Contract Text
We store your order and the order data you have entered. You will receive an email with the order confirmation containing all the order details. You can print out your order and the General Terms and Conditions before submitting it. If you have a customer account, you have access to your orders at any time.
4. Right of Withdrawal for Consumers Cancellation Policy
Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, takes possession of the goods.
To exercise your right of withdrawal, you must inform us (TOURING Modelcars, Thomas Langejürgen, Bunsenstr. 1, D-32052 Herford, Germany, Tel. +49 (0) 5221 182 555, Email: info@touring-modelcars.com) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached model withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for the additional costs arising if you have chosen a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive the notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the initial transaction unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
The right of withdrawal does not apply to contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer (e.g., custom engravings).

6. Prices
All prices are exclusive of statutory VAT, any customs duties, and all other price components and shipping costs.
7. Payment Terms
7.1 Payment can be made in advance, by invoice, credit card, cash on delivery, PayPal, AmazonPay, or instant transfer. If you choose to pay in advance, you will receive our bank details in the order confirmation, and the goods will be delivered after payment has been received. The invoice amount must be transferred to our account within 14 days. For credit card payments, your account will be charged upon completion of the order. For payments via PayPal, AmazonPay, or instant transfer, you will be redirected to the payment pages of the respective provider. Cash on delivery payments are due upon receipt of the goods.
7.2 For consumers, a default interest rate of 5% above the base rate applies in the event of late payment. For businesses, the default interest rate is 8% above the base rate. We reserve the right to prove and claim higher default damages.
8. Delivery Terms
8.1 We deliver exclusively within Germany and to the following countries: Argentina, Australia, Belgium, Brazil, Bulgaria, Denmark, Estonia, Finland, France, Greece, India, Ireland, Italy, Canada, Qatar, Latvia, Liechtenstein, Lithuania, Luxembourg, Malaysia, Malta, Monaco, New Zealand, Netherlands, Norway, Austria, Philippines, Poland, Portugal, Romania, Saudi Arabia, Sweden, Switzerland, Singapore, Slovakia, Slovenia, Spain, South Africa, Czech Republic, Hungary, USA, United Arab Emirates, United Kingdom (UK), Cyprus.
8.2 Unless otherwise specified, the goods will be dispatched within one week after receipt of payment. The delivery time is 5-7 days.
9. Warranty and Liability
The warranty is provided in accordance with legal provisions.

11. Legal Jurisdiction
11.1 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. In the event of disputes concerning the meaning and interpretation of clauses in the English version of these General Terms and Conditions, the German wording shall prevail.
11.2 For customers who enter into the contract for purposes that are predominantly outside their trade, business, or profession (consumers), this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
11.3 For all disputes arising from the contractual relationship, if the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Bad Oeynhausen.
12. Miscellaneous
12.1 The contract languages are German and English.
12.2 If one or more provisions of these GTC are invalid, the remainder of the contract remains valid. Insofar as the provisions are invalid, the content of the contract shall be governed by statutory provisions.
